In this Privacy Notice, we describe the Personal Data that we collect from you in connection with our activities, how we use and disclose that data, and your options to access or update your data.

This Privacy Notice may be amended from time to time. We, Nadace The JetBrains Foundation, with the registered address at Na Hřebenech II 1718/8, Nusle, 140 00 Praha 4, Czech Republic, ID: 059 92 419, registered in the Foundations Register kept by the Municipal Court in Prague, Section N, File1490, are the data controller of your personal data collected and processed regarding the activities described in this Privacy Notice in accordance with our beneficial purpose:

(a) providing long-term and strategic support for the advancement of society, science, and the development of technologies that are beneficial and add value to society;

b) providing targeted support and assistance to national minorities, migrants, or politically, racially, or otherwise persecuted or disadvantaged persons in the Czech Republic and abroad, who can reintegrate into and benefit society with this assistance.

Why We Collect Data and What We Collect

We collect data for various purposes, under various legal bases, and for certain periods, as specified below:

a) To promote the existence, purpose, and activities of the Foundation - We will search for, identify, inform, approach, and communicate with end beneficiaries of any projects suitable for supported from the Foundation, confirm interest in a particular project, run marketing campaigns supporting our activities, and link individual end beneficiaries with natural and legal persons involved in the implementation of initiatives, activities, and projects supported by the Foundation.

We may process your personal data to determine the content, scope, and particulars of the initiatives, activities, and projects, to find appropriate target end beneficiaries, and to assess and decide whether you are eligible for the support by the Foundation. We will usually base this processing of your personal data on your consent and will inform you about the length of such processing when we ask for it.

b) Internal Evidence and protection of our rights and interests - We may process your personal data for keeping internal evidence about our activities (mainly provision of monetary funds to legal or natural persons implementing initiatives, activities, and projects aligned with the purpose of the Foundation, reporting by donees on progress of such initiatives, activities, and projects, and on compliance with the terms of use of the funds) and the protection of our interests. Our legal basis for such processing is our legitimate interest in keeping such documentation and in our protection. We may store your data for this purpose for up to 10 years as of the donation.

c) Fulfillment of legal duties stipulated by accounting, taxation, and other law – We will process your personal data when we are required to do so by law (in order to benefit from tax advantages granted to non-profit organizations, we need to document and prove that the monetary funds were provided in line with the beneficial purpose of the Foundation). In such cases, our legal basis for processing will be compliance with our legal obligation. The duration of this processing will be as required by law or as necessary for the fulfillment of legal duties.

What Personal Data We Process

Categories of data involved in data processing include:

  • Name and surname
  • Email address
  • Phone number
  • Address
  • Date of birth
  • Passport number or number of other documents (ID card, visa, etc.) or even a copy of such documents proving entitlement for support from the Foundation

We may provide our services to children under the age of 15. If you are a child under the age of 15, we may collect and process your personal data only with the additional consent of your parents or a guardian. If such consent from a parent or guardian cannot be provided for objective reasons and you would like to apply for support from the Foundation or participate in an initiative, activity, or project supported by the Foundation, please contact us.

Who May Access Your Personal Data

In order to achieve the purpose for which Personal Data is collected, we may share the Personal Data with certain third party recipients engaged by us in our initiatives, activities, and projects. Such recipients may include:

  • JetBrains s.r.o., registered address Na Hřebenech II 1718/8, Nusle, 140 00 Praha 4, Czech Republic, ID: 265 02 275, as the founder of the Foundation.
  • Third parties we cooperate with in order to achieve the beneficial purpose of the Foundation (i.e., other non-profit organizations that we support financially, landlords, educational institutions, or other service providers).
  • Third party service providers which help us run our non-profitable activities (i.e., IT service vendors that provide data storage and backup services, legal and tax advisors, external accountants), which are subject to confidentiality obligations.

We may also share your Personal Data with certain third parties if we are obliged to do so under applicable legislation (especially with tax authorities or with other government bodies exercising their statutory powers) or if such sharing is necessary to achieve the purposes defined above (especially with government bodies or with parties harmed as a result of violations of applicable laws).

Security

We review the processes of Personal Data usage before implementing them. This is done to minimize data usage and to make sure that you as the data owner are informed about the processing. When the reason for data storage expires, we remove your Personal Data from our servers.

We use partners to host our services and websites and to process your data that comply with the security requirements of JetBrains Group. While choosing the partners, we ascertain their compliance with legal regulations and security standards to make sure your data is stored in a secure location with appropriate security measures in place.

Location of Your Personal Data

Any servers or services that contain personal data are located within the EU.

Your rights

As set out in locally applicable Personal Data protection laws, you may have the right to: (i) request access to your Personal Data; (ii) request rectification of your Personal Data; (iii) request erasure of your Personal Data; (iv) request a restriction on the processing of your Personal Data; (v) request Personal Data portability; or (vi) object to the processing of your Personal Data.

  • Right of Access. You may have the right to obtain a confirmation as to whether or not Personal Data concerning you is being processed, and if so, to request access to your Personal Data. The information about Personal Data processing includes the purposes of the processing, the categories of Personal Data concerned, and the recipients or categories of recipients to whom your Personal Data have been or will be disclosed. However, this is not an absolute right and the interests of other individuals may restrict your right of access. Further, you may have the right to obtain a copy of your Personal Data undergoing processing. For additional copies requested, we may charge a reasonable fee based on administrative costs.
  • Right to Rectification. You may have the right to obtain the rectification of inaccurate Personal Data. Depending on the purposes of the processing, you may have the right to have incomplete Personal Data made complete, in particular by providing a supplementary statement.
  • Right to Erasure (Right to Be Forgotten). Under certain circumstances, you may have the right to require us to delete your Personal Data.
  • Right to a Restriction of Processing. Under certain circumstances, you may have the right to require us to restrict the processing of your Personal Data. In this case, the respective Personal Data will be marked and may only be processed by us for certain purposes.
  • Right to Personal Data portability. Under certain circumstances, you may have the right to receive the Personal Data concerning you, which you have provided to us, in a structured, commonly used, and machine-readable format, and to transmit these Personal Data to another entity.
  • Right to Object. Under certain circumstances, you may have the right to object, on grounds relating to your particular situation, at any time to the processing of your Personal Data by us and we can be required not to longer process your Personal Data.
